California Law and LEX OMNI LAW FIRM are on your side. You work hard and should never drive a Lemon!
The Song-Beverly Consumer Warranty Act commonly known as California Lemon Law requires manufacturers of new
motor vehicles to promptly replace or repurchase such vehicles if they suffer from defects that cannot be repaired
within a reasonable number of repair opportunities. (Civ. Code 1793.2(d)(2)(B).) Contrary to popular belief,
the Song-Beverly Consumer Warranty Act imposes additional requirements on manufacturers and gives consumers causes
of action for other violations as well. (Civil. Code 1794(a).) For example, Civil Code section 1793.2(b) provides,
Unless the buyer agrees in writing to the contrary, the goods shall be serviced or repaired so as to conform to
the applicable warranties within 30 days.
California law requires warranty repairs to be completed with thirty (30) days. (See, Civil Code 1793.2(b).)
This is commonly referred to as the Thirty Day Rule and is part of the California lemon law. If you had a
vehicle in for warranty repairs and is been at the dealership for longer than thirty days because the parts
are on backorder, you may have a claim against the manufacturer and dealership.
California law requires car dealers to disclose material damage to vehicles even if it has been repaired prior to sale.
(See, Vehicle Code 9990.)
Regardless of where you purchased the defective vehicle, members of the Armed Forces have the right to sue under the
California lemon law if they are stationed in California.
California law provides the annual amount for vehicle license fees shall equal .65 percent of the vehicle market
value (Line 1(A)(1) on the sale contract). It further requires dealerships to reimburse consumers for any overage.
